I don't see how this argument helps "gag or not," for two reasons.  The number of people aware of the remarks isn't an element of the offense; and the website remarks can be and usually are magnified by media repetition.

Simply by filing this motion, the state allowed O'Mara to spend 30+ minutes with new detail, present the media with a Scheme team primer, introduce the HOA liability motion and reassert all the prejudicial treatment from the media in the opening phase of this case.

Corey expressed concern for an impartial jury due to publicity during her big press conference, yet she did not motion for a gag order at that time. O'Mara was not even involved in the case yet, at that time. The demand for a gag order now is disingenuous and transparent.

BDLR is working hand in hand with Crump, Parks, Jackson and Rand according to Corey. Again from Corey's big press conference: "And as I stated, Mr. de la Roinda has been in touch with Mr. Crump and with Ms. Fulton and Mr. Martin since we took over this case. And we intend to stay in touch with them."

COREY: You asked about my concerns. I will tell you. There has been an overwhelming amount of publicity in this case that we hope does not keep us from being able to pick a fair and impartial jury. Both the state and the defense are entitled to a fair and impartial jury. We think a lot of facts got put out. See, that's the problem. When I told you it comes out in front of the jury, they are not allowed to render a decision until everything is in front of them.

I don't trust Mortimer entirely.  In the last hearing he heaped praise upon praise on media lawyer Ponz for leaving court right after he got something he wanted.  As a matter of fact, Ponz didn't leave and spoke again shortly before the end of the hearing.  But he does seem to make some good points.  I would like to hear the opinion of the courtroom lawyers here about Mortimer's comments.

On the other hand if it is magnified by the media...then it is no longer bypassing the media which seemed to be BDLR's concern.

During her big press conference, Corey stated that the investigation take-over happened before SPD had the opportunity to complete their investigation. There has never been a satisfactory explanation as to why the investigation was abruptly taken away from SPD. It just mysteriously 'changed course.'

But before the investigation could be finished, there was a lot of outcry about this case. And then, it changed course and we got appointed to take over the investigation.

Without an actual quote from an SPD official stating 'it had completed its investigation' this is nothing more than conjecture by the Sentinel on March 13.

When Chief Lee stepped down on March 22, he clearly indicated the investigation was not over by stating his hopes "that the investigation process will move forth swiftly."
