Today's hearing is scheduled to begin a 9:00 AM EDT. A live web feed can usually be found at WKMG. HLN (Headline News) will also broadcast the hearing for those who prefer to watch via cable/satellite.
 
Mark O'Mara revealed during this weekend's press dinner that George Zimmerman will attend the hearing.
 
Discovery:
 
Demand for Specific Discovery (Zimmerman phone data): Zimmerman is seeking any downloads or information in the state's possesion regarding any phone or phone number connected to George or Shellie Zimmerman.
 
 
Demand for Specific Discovery (Trayvon Martin phone data): Zimmerman is seeking any downloads of information in the state's possesion regarding any phone or phone number connected to Trayvon Martin.
 
 
Demand for Specific Discovery (Enhanced Audio): Zimmerman is seeking information regarding any cleaned up, edited or enhanced audio of 911 calls listened to by Tracy Martin. This is in response to Mr. Crump's claim that Tracy Martin changed his opinion of the identity of the person screaming in the 911 tape after hearing an enhanced version.
 
 
Redacted Motion to Allow Addition Witness Disclosure: Zimmerman is asking to add 6 redacted witnesses to its list past the agreed-upon deadline.
 
 
Sanctions:
 
Defendant's Motion for Sanctions Against State Attorney's Office for Payment of Attorney Fees and Costs: This is regarding the state's refusal to allow W8's deposition to be videotaped. The state has filed a response.
 
Defendant's Motion for Sactions Against State Attorney's Office for Discovery Violations: This is regarding the state's failure to disclose in a timely manner the fact that W8's had lied about visiting the hospital. The state has filed an entertaining response to this motion, complete with quotes from the bard. Mark O'Mara replied to that response, asking that it be stricken from the court file as argumentum ad hominem. In his reply, MOM cites examples from the Florida Bar of similar tactics being subject to sanction.
 
State's Motion Objecting to the Release Of Victim's Family Personal Information: The state complains that O'Mara inadvertently released personal information for Martin in his Motion to Unseal.
 
 
HOA Settlement:
 
Motion to Unseal Information Listed as Confidential: Zimmerman is seeking to unseal the HOA settlement with the Martin Estate, arguing that the settlement contains information relevant to Zimmerman's defense. Crump opposes, O'Mara replies to that opposition.
 
 
Immunity Hearing:
 
State's Motion Requesting Court Inquiry of Defendant: The state would like the court to inquire into Zimmerman's plans to invoke immunity in this case or waive that process.

That audio issue was the pool camera across all feeds. It's working now, though.

West says that deposition testimony suggests that the phone data in defense hands is incomplete.  In particular, some text messages.  He also says there may be additional information (he doesn't know what, so it's not possible to specify what is missing).  He says defense is unable to extract information from the data files.

Bernardo speaks.  He sounds subdued, respectful.  Says the state has provided all that it has.

It was an unidentified female, probably W-8, who said in her deposition that what the defense showed her didn't include all her texts to Trayvon.

Steve Brenton was deposed twice.  I suppose that tosses out the window the theory that the defense won't be allowed a second bite of the apple for anybody.  Nothing was mentioned concerning GPS data.  It remains a mystery whether it exists for Feb. 26. 2012.

Nelson takes up the "enhanced 911 call" that Crump refers to as resulting in Tracy Martin changing his statement as to who's voice is heard screaming for help.  West says he is seeking clarification.  West attributes the claim of "cleaned up" audio to Crump.  West says he doesn't know what "cleaned up" consists of, something Crump did, something the state did, or otherwise altered.

De la Rionda is claiming ignorance, except that the state did not alter any audio for Tracy, and that Crump may be referring to better listening gear being used when Tracy listened to the recording at city hall.  De la Rionda says the only modified audio is being prepared by experts, none of which was provided to Tracy.  West says the expert's activity isn't the issue - the issue is what Tracy listened to, and Crump's remark that Tracy listened to a cleaned up version.

Nelson says she will not inquire of Crump - that issue is before the DCA, and she is going to stand on her ruling that Crump is (now) not a witness, so the Court will not inquire of Crump.

Defense motion denied.

Did I hear right that there are "audio experts" now working on enhancing the 911 scream tape?  So there will be a challenge to the FBI conclusion that the info from the call is useless for voice identification?

O'Mara apprises de la Rionda of the testimony that a witness will provide, and de la Rionda is concerned.  Nelson will allow the witnesses; and will also allow the state to add witnesses in light of new information.

Motion granted.

Court inquiry re: waiver of immunity.  Nelson asks to swear Zimmerman in so she can asks questions.  O'Mara says he objects (says it is inappropriate to make inquiry of the defendant).  O'Mara is right, until Nelson says what the law is, it is inappropriate to ask Zimmerman of his intention.

I think you heard right that experts are working on the audio, but there was no contention they would arrive at any conclusion different from what the FBI did.
