Tracy Martin made a speech, then he, Crump, and the rest of the family took their seats.

Back to test pattern.

ETA: I'm watching at ClickOrlando.

ETA2: I didn't catch much of the speech, since I had audio muted for the test pattern. Thanks to supporters, they are praying, etc.

Judge Nelson has opened proceedings. First will be defense motion for continuance.

O'Mara said they weren't ready. I didn't catch why. I think they are waiting for someone to arrive.

ETA: I don't see West. They may be waiting on him.

The motion has something to do with more material they received on June 4 from Trayvon's cell phone.

They are not fully ready.
They need more time, they can't even say how much.

Bernie says O'Mara has "a slew of attorneys."
They have an expert for the phone data.
Crump's depo should only take a half hour.

motion for continuance denied

Court asks if Zimmerman can stay in courtroom while the lawyers go downstairs to introduce themselves to jury pool. O'Mara says he'd rather George go with them. Judge says fine.


Jury selection expert is Robert Hirschhorn. He's excellent.

8:59 - Court in session, on the record.  First item will be the motion to continue.  Court is waiting for Zimmerman to clear whatever gauntlet the court has established for entering the courtroom.

9:01 - Zimmerman in the courtroom.  O'Mara argues for continuance.  New items.  Report (phone contents as run through Cellbrite) received on 6/4.  Also have report of an expert.  Neither of those has been analyzed by defense, and it will take maybe 100's of hours.  Reich's report won't be complete, but that issue is contingent on Nelson's decision as to admissibility of Reich.  Crump's deposition is accomplishable, but information uncovered during that deposition needs to be followed up.  Defense has spent 1000's of hours, but the defense isn't ready, and doesn't want issues to come up at trial.  Time required may be as short as a couple weeks, but no way to tell.

Bernardo objects.  Disagrees with fact contentions in O'Mara's motion.  Crump's depo won't take but half an hour.  Turn over of BIN file was sufficient, as defense expert is able to extract material, and has demonstrated ability to do better than the state; plus that material is irrelevant to trial.  O'Mara disagrees that the court has ruled it irrelevant.

Nelson denies the motion to continue (edited).

State's motion to compel discovery is resolved.

Nelson wants to defer the motion as to inflammatory words to just before opening statements.

O'Mara asks to revisit the sanction motion, and says it should be resolved before jury selection.  He argues that defense has been prejudiced, and asks the court to relax authentication and other rules as an alternative remedy, if evidence is relevant and otherwise admissible.  Nelson says she will allow argument on that on an issue by issue basis.

Nelson describes the selection process.  Jurors do not have questionnaires yet.  A judge is working downstairs to do preliminary juror qualification.  Bernardo notes that there has been agreement by the court that it would modify the questionnaire, and he has not seen the modification.  O'Mara and Bernardo approach the bench to review Nelson's questionnaire.

My pleasure.  I'm apt to disappear though, have paying work that has to be done.  I try to leave a remark to that effect. If I start taking/leaving notes here, I assume people come to rely on that, so I give notice that I am "going offline" so somebody else can take up the slack.
