E-54 isn't leaning one way or the other.

At first he thought the SPD did a thorough job at the scene before deciding not to charge. He thinks something must have come in later investigation to cause 'them' to rethink. Doesn't seem to know a different agency did later investigation.

Bernie done. West up.

He doesn't recall TM's family's lawyers having press conferences.

West again asks for an estimate of how many times the candidate has heard anything about the case. This one declines.

He hasn't expressed a view in discussions. He tells people he can't have a view until he has heard everything.

He hasn't talked to co-workers about the case, doesn't think his wife has expressed an opinion. She follows news less than he.

He doesn't think the hoodie is significant in the case, by itself.

He thinks he first heard the word 'hoodie' in connection with the case.

He doesn't have a reason to think the hoodie in itself is a significant part of the case.

West asks if he thought SPD investigation was shoddy or incomplete. He didn't.

West pressing on his assumption that there must have been new evidence.

E-54 says he won't speculate about evidence not in court.

He didn't attend any events, or sign petitions, or watch hearings on TV.

West is done. Sidebar.

I have to go. I don't know if I'll be back before it's over.

NM_NM, thank you for your terrific updates all day. I really appreciate them, and know other readers do too.

The sidebar is still going on. The lawyers and judge seem pretty relaxed, there have been a few smiles, even from the Judge and Don West.

Court in recess for these proceedings until 9AM EDT Wednesday. No voir dire between NMNM's last post. The court will read admonitions in the jury holding area.

Sidebar over. Court announces recess. O'Mara says he has one more thing to discuss. He and BDLR return to the bench. Bernie puts his arm around O'Mara as he's saying something to him.

Court recesses, Judge leaves the bench.

Thanks again to NM-NM for following today's proceedings here.

BTW, if there's a scheduling conflict for the regular commentators, I can fill time slots. PMs are welcome.

I want to follow up a bit on what E-54 said about hoodies. It was hard to summarize because hard to understand.

He said he didn't think it was bad to wear a hoodie, but he had a talk with his son about being careful wearing a hoodie in some way he didn't specify. He might have meant not to wear it in inappropriate weather, as Geraldo notoriously suggested. (It seems Geraldo wasn't aware that it was raining on the night of the shooting.) Or maybe he meant not to wear it in certain places or among certain people. Whatever he meant, he didn't say.
