E-40: Both types of evidence are important, and it's important to differentiate them, and question whether they mesh with each other.

O'Mara give E-28 a friendly warning. If he sees a juror nodding or shaking their head, he's likely to call on them.

He's talking about how the judge will instruct, talking about 'abiding conviction of guilt'.

Bernie objects that O'Mara misstated something. Nelson tells jurors that she will instruct them in the law.

Bernie objected again. Nelson asked him if he would like her to read instructions on reasonable doubt now. 'Yes.' She did.

O'Mara asked the jurors if they have concerns about the idea that they must acquit if their conviction of guilt wavers. He says now is the time to talk about any concerns they have.

O'Mara said it wouldn't be proper for him to read to them Webster's definition of 'abiding', and they shouldn't consult a dictionary either.

O'Mara asks for a show of hands on who has been on a jury in a civil case, asks one of them to recall that they were instructed on a preponderance of evidence burden.

Bernie objected that the other standard is irrelevant. Nelson overruled.

The juror says he has never been comfortable with the standard in a civil case being so low, but he understood that was the law.
