O'Mara on direct.

DS: She was present when Serino met with Tracy (news to me).

Looks like O'Mara won.

DS: 2 days after shooting, Tracy came to talk to Serino, was concerned there had been no arrest.

Objection, hearsay.

Nelson says DS not to testify to what anyone said.

She's out of uniform too, FWIW.

She took some (undeserved) flak because her ribbons were recycled military awards, and she is not entitled to wear them as military decorations.

O'Mara must have won the sidebar.  Now Nelson takes away the right to meaningful examination, by not allowing the witness to describe Serino's addressing Tracy Martin as to why an arrest could not be made.  This was 2-3 days after the shooting.  She about 8-10 feet from Serino's desk.  She overheard the 911 call being played at least once.  Without giving Tracy's verbal response (this is forbidden hearsay), describe Tracy's reaction.  Sad, hung head.

O'Mara asks a question, prefaced by saying it will be objected to.  What did Tracy say?  Objection.  Sustained.  Singleton dismissed subject to recall.   Serino is next witness.

DS: 911 called played once, she isn't sure if it was played more than once. Tracy was upset, hung his head, cried.

Nelson wouldn't let O'Mara ask what Tracy said.

No cross. DS excused, about 1:45 PM.

Serino next.

I don't see how it can hurt his case.  At worst, these are a waste of time.

I think the jury is smart enough to realize that Tracy didn't testify for the state and what it means that the state won't let the police answer what they heard Tracy say.

Ahh, thanks.  I hadn't considered that.  Although, I believe the fact that Tracy first said is was not Trayvon has been said, so all that's missing is hearing it from Singleton, as defense witness.  I'm not sure if the only venue for that fact coming in has been opening argument.

We do have Tracy though, hearing this tape long before Sybrina did.  He's hearing it 2-3 days after 2/26, and Sybrina first heard it in the mayor's office a couple weeks later.

I would also expect that Tracy would be devastated, regardless of which voice he thinks he is hearing.

O'Mara on direct, asking how close she was to Serino and Tracy.

DS: She was not part of conversation. Serino asked if Tracy recognized the voice, he said it wasn't his son. She doesn't recall Brandy Green expressing an opinion.

ETA: On direct, DS repeated earlier description of Tracy's body language.

DS: She doesn't recall Tracy's exact words. She has children, felt horrible for Tracy, she felt choked up.
