Week 3, Wednesday, 7/9/13
« on: July 10, 2013, 03:13:03 AM »
Here's a place for live updating and thought for July 9. Feel free to use the witness threads for specific witnesses   The server is on for now, but I am not sure how long it will last. Coilin is a terrific webmaster , I can call his cell 24/7 and always get him. After 11 years, my server is packed and it's a question of finding the right allocation of resources between TalkLeft and the Forums. Colin's on top of it and will keep watching it so if it goes offline, he should see it or you can send me an email. Thanks for your patience.

O'Mara asked for sidebar.

Sidebar.

Judge Nelson seems chipper today.

Sidebar is over. Nelson reading a document. WFTV talking head says it was just presented to her.

Nelson reading case citations aloud.

Animation is out as evidence, OK as 'demonstrative exhibit'.

Phone evidence is out.

Nelson asked GZ if he understands he has right not to testify, he does. She said he also has right to testify, and she wants him to be in consultation with his lawyers on the matter and be thinking about it.

Seems like there might be a sick juror-JDN said "if you need to leave the courtroom just raise your hand and we'll take a recess."

Nelson asking if any jurors broke any rules.

Nelson told one of the jurors, I think E-6, to tell her if he needed to leave.

Next witness is Dennis Root, self-defense expert.

Root sworn, 9:19 AM.

I bet had Trayvon Martin threatened the life of the judge or her family, his texts would be admissible. According to her ruling, you are free to libel, slander, or threaten anyone and claim someone else used your computer or phone. Further, why can't people sued by the RIAA for illegally downloading music use this reasoning?

1:46 PM

O'Mara put in evidence a declaration from the city of Sanford, DE 25, no objection from state.

Ditto documentation for GZ's carry permit and the last of the 911 calls, DE 26, 27.

Also a DE 28, I didn't catch what it is.

O'Mara said he has 2 more witnesses.

Nelson addressed GZ. Has he talked to lawyers about whether he wants to testify? Yes.

GZ was sworn.

GZ: He has discussed testifying with lawyers, he has made no decision.

Nelson: How much more time does he need to discuss this with lawyers?

West kept objecting, Nelson kept overruling, getting increasingly angry.

GZ and Nelson went back and forth over when he would give her his decision.

Nelson angrily told GZ she would give him more time to discuss this with lawyers.

O'Mara asked for sidebar, 'unrelated matter'.

Sidebar.

I missed him speaking. Schaeffer says he won't testify, Hornsby says he wants to testify, did  you get that impression?

He needs to not testify.
