Having read the article I am ambivalent concerning the wording. Maybe Nifong will respond, in part, to the motion on Friday.
I wish I had a link to the actual document. Maybe it will appear later in the various media (inmyhumbleopinion you are great at finding documents, maybe you will be able to locate the motion).

Oh my God. It sounds like she was covered with male DNA both in and on her body. And none of it was from any lacrosse player. And the lab never reported it. Why not? It's exculpatory and legally that information has to be turned over. If Nifong had a hand in this he is dead meat. He has alot of explaining to do.

Wow. If you read that article carefully it is pretty damning. It means that Nifong was told on April 21st that there was evidence of DNA from multiple males on the rectal swab and the panties, none of which matched any of the three accused or the other players. Yet this very important evidence was missing from the final report. That means it wasn't known to defense witnesses until they specifically requested it. That means it wasn't in the discovery. Sounds like we've got an obstruction of justice charge brewing here. It clearly says that the private company violated their own policy about the requirement to release ALL data in their report. I wonder who told them to do that? Obstruction of justice and violation of civil rights. And it's clear that NO prosecutor under normal conditions would proceed with a case against the lacrosse players once that information was known. Nifong had to keep that under wraps so he could go ahead and indict someone.
There's been a lot of poo-pooing about DOJ on here. If I were Nifong I'd be sweating pretty heavily right now. Anybody who is still saying he has his ducks in order is dreaming. This is a nightmare for him that's not going away. The political storm has just begun. Once one congressman speaks out, it's only a matter of time until they all jump on the bandwagon.

The North Carolina Bar will move in on Nifong before the Feds.Better to clean their own house. Questions: Does the case get dismissed quickly by Judge Smith;or does a new prosecutor first have to be appointed to acquiese in the defense motion for dismissal on the grounds of criminal misconduct?
No wonder the orcs are silent. They are all over on the sixth floor of the Durham Courthouse shredding and deleting incriminating statements.

Don't know if this is what Mr. Michaels meant or, if not, if he will claim it is, I definitely feel the earth shaking and I live quite a distance from Durham. It feels just like the earth quakes I remember when I lived in Japan. At first reading, this is definitely something big. But, like everything in this case, there will be some kind of twist. Just don't know who will be twisted.

The defense has to file a motion to dismiss first. I don't think the judge can just dismiss it without that - he'd be taking an adversarial position. I would think there would have to be a hearing at which the defense and Nifong will argue the issue. Then the judge would rule. I don't think there's any need for a new prosecutor to step in.

Nifong is in a whole lot of trouble. If this case goes past Friday, then the whole justice system is way out of whack.
Not even her boyfriend's DNA, either.....
