I'm glad they are being allowed to do that. I'm not sure I'd want to go back to Duke in their situation. I'd start out fresh somewhere new, but thats not my decision.

Sources emailed me...there is already on-campus reaction...not sure when this week the announcement is scheduled for...obviously, if true, and i believe it to be, this would be a strong show of support from the school, and an absolute damnation of nifong and his case.
In effect, the administration must solidly believe there is no case now.
No word if we're talking this semester for the finnerty/Seligmann return.
The sources are good, and in writing, so I'll hang my neck out there. I'm giving it to Talkleft first because I suspect this may happen by Thursday when both The Carolinian and Wilmington Journal hit the streets.

I would stay away if I were they. By returning they risk assault by locals (or visiting militants), further vilification by radical leftists (including the faculty), and further persecution by the police. (And I don't mean they are in danger from everyone in Durham...it just takes a handful.) Also, after the way Duke treated them, why return? In any case, Cash's comments on the implications of this news is right on the mark.

If they are allowed to return while still facing felony charges, it will set an interesting precedent for future indicted felons. The only way I can see this happening is if something else goes along with it, which would have to be the dropping of all charges by Nifong. However, the charges being dropped would be a much bigger story, so it seems an odd rumor to me by itself.

If Cash's report is correct, it may just mean that Brodhead and Co. have decided that they have no choice but to face reality...given the recent nationwide groundswell of support for the Duke Three, they have to be feeling the heat. Is there any reason they'd be likely to have inside knowledge of the charges being dropped? That seems unlikely to me. [shrug] I suspect they will reinstate, but whether Reade and Collin will return to campus is another matter...I thougth Seligman was shut of the place.

Michaels' statement suggests that the university has agreed to allow the players to return, before the resolution of the case. Duke has maintained for several months that the players could return only if they were found not guilty or if charges were dismissed. However, Duke has its own rules to follow and they did so by expelling the students. Many people complained then but it really was just following the rules. I don't believe these rules will be circumvented in this case, although I think the charges are virtually groundless.
